Sara Leon & Associates successfully obtained summary judgment on behalf of a school district in a lengthy dispute involving a student’s eligibility for special education. The parent challenged a determination that the student was not eligible for special education after the district conducted a full individual evaluation. After the district prevailed at a due process hearing, the student appealed that decision to the U.S. District Court for the Eastern District of Texas. The court upheld the hearing examiner’s determination that that the student had not been not denied a free appropriate public education. The student objected to the ruling and asked the court to reconsider its judgment. On April 1, 2020 the United States District Court for the Eastern District of Texas denied the parent’s motion to reconsider and issued final judgment in favor of the school district, affirming the district’s eligibility determination.
