Leon | Alcala to Represent the Lyford Consolidated ISD and Taxpayers Before the Texas Supreme Court
On June 20, the Texas Supreme Court granted review in Busse v. South Texas ISD, a case challenging the property tax levied by South Texas ISD. Leon | Alcala attorneys represent the Lyford Consolidated Independent School District and some of its taxpayers, who assert that the South Texas ISD property tax is unlawful as it was never approved by the voters. The Thirteenth Court of Appeals agreed that the property tax should have been, but never was, submitted to the voters for approval, but ruled that neither the impacted taxpayers nor the school district had standing to challenge the property tax in court. In 2022, the property tax levied by South Texas ISD within Lyford CISD generated a stunning $62,500 per student for each Lyford CISD student attending South Texas ISD. South Texas ISD also receives full funding from the state in addition to its local property tax levy.
